General

Please note that the practices of Netformx, Inc., its affiliates, and agents ("Netformx"), with respect to data collected and used by Netformx in connection with this website (www.netformx.com) and additional websites associated with Netformx (collectively, the "Site") and Netformx products and services available or enabled via the Site ("Products and Services"), are governed by this online privacy statement ("Privacy Statement") as amended from time to time. This Privacy Statement does not apply to those products and services that have their own privacy statements.

Automatic Data Collection

When a visitor requests a page of information from the Site, information about the request is automatically stored in a log file. This information includes the address of the visitor making the request (the Internet address, not the street address), the time and date of the request, the type of web browser being used, and sometimes, the page from which the visitor is coming. The information does not contain the visitor's name or e-mail address, since the visitor's browser does not provide this information to the web server. Netformx analyzes these log files to learn about how visitors are using the content on the site. This information is used to allocate resources effectively and improve the content of the Site.

Collection of Your Information - Voluntary Registration

Certain parts of the Site require that visitors and users provide their personal information, which is any information that identifies, relates to, describes, or is capable of being associated with, a particular individual, such as (without limitation), name, e-mail address, billing information and other personal information, which is recorded in databases on Netformx' servers (the "Personal Information"). This Personal Information is kept strictly confidential; it is not shared with or sold to other companies. It may, however, be used internally by Netformx for a variety of reasons, such as processing your order, enabling the use of certain features of the Products and Services, or personalizing your experience.

If you choose to provide third party Personal Information (such as name, email and phone number), Netformx will assume that you have the third party's permission to provide Netformx the information. Examples include forwarding reference material or job referrals to a friend or colleague. This information will not be used for any other purpose.

In some instances, Netformx may collect non-personal (aggregate or demographic) data through cookies, web logs, web beacons and other similar applications. This information is used to better understand and improve the usability, performance, and effectiveness of the Site. Please read the “Cookies” section below for more information. In addition, by using some of the Products and Services, anonymous network information may be transmitted to Netformx such as the performance of the Products and Services and types of devices attached to the network. With this information Netformx can determine how users are interacting with the Products and Services, to assist Netformx with improving such Products and Services and to provide alerts via the Products and Services of available software updates/upgrades.

Uses of Your Personal Information

Netformx will only use your Personal Information in the way specified when it was collected. Netformx will not subsequently change the way your Personal Information is used without first asking for your permission. Some of the ways Netformx may use Personal Information include to deliver Products and Services that you have requested, support the Products and Services, contact you for customer satisfaction surveys, personalize websites and newsletters to your preferences, administer and process your certification exams, or communicate for marketing purposes. You can edit your preferences at any time (Please see Your Choices and Selecting Your Communication Preferences clause below).

Netformx may collect information about the use of the Products and Services and the Site, such as (without limitation) the number of downloads, types of Products and Services used, how many users use the Products and Services, Site pages visited. This information is generally collected in aggregate form, without identifying any users individually. Other exceptions to this, where an individual may be identified individually, are noted in this Privacy Statement or in additional privacy terms connected to a specific Product, Service, or website.

Netformx may use aggregate, non-identifying statistical data for improving the Site and the Products and Services, providing more relevant experiences to its customers and for statistical analysis.

Security of Your Information

Netformx is committed to protecting the Personal Information or any other information you share with it and utilizes a combination of industry-standard security technologies, procedures, and organizational measures to help protect your Personal Information or any other information from unauthorized access, use or disclosure. Netformx recommends you to take every precaution in protecting your Personal Information when you are on the Internet.

Sharing Your Personal Information

Netformx does not sell or share your Personal Information to third parties for marketing purposes unless you have granted Netformx permission to do so. Netformx will ask for your consent before Netformx uses or shares your information for any purpose other than the reason you provided it or as otherwise provided by this Privacy Statement. Netformx may share Personal Information in the following ways:

  • A. Within Netformx, its parent company or with any of its worldwide subsidiaries for purposes of data processing or storage.
  • B. With business partners, service vendors, authorized third-party agents or contractors to provide a requested service or transaction, including processing orders and credit card transactions, intelligence and analytics services, hosting websites, hosting seminar registration and providing customer support (if any). If applicable, Netformx only provides these third parties with the minimum amount of Personal Information necessary to complete/provide the requested service or transaction. Netformx does not allow third parties to use your Personal Information for a different purpose.
  • C. To comply with the law or legal process (such as responding to subpoenas or court orders) and to exercise Netformx's legal rights or defend against legal claims.
  • D. To investigate, prevent, or take action regarding illegal activities, suspected or potential fraud, brand protection, situations involving potential threats to the physical safety of any person, violations of Netformx’s terms of use, or as otherwise required by law.
Cookie and other Web Technologies

Netformx as many more websites, uses automatic data collection tools, such as cookies and web bugs. Such tools collect certain standard information that your browser sends to the Site such as your browser type and the address of the website from which you arrived at the Site. Such tools may also collect information about your Internet Protocol (IP) address and clickstream behavior (for example, the pages you view and the links you click). These tools help make your visit to the Site easier, more efficient and more valuable by providing you with a customized experience and recognizing you when you return.

A. Cookies

A cookie is simply a small piece of information that a web server asks your browser to store on your local computer, and then later your browser presents this information to the web server. In its simplest form, a cookie is just an identifying number. Some sites have sophisticated databases which link the cookie numbers to personal information so that they could monitor exactly what a particular visitor does on the web site. It is important to note that this personal information would have to be voluntarily provided to the web site by the visitor (by filling out an online form). Netformx uses cookies for access to password-protected areas of the Site. Once a user enters a user name and password, a cookie is created to allow the user to navigate freely throughout the password-protected section, without the need to continually re-enter a username/password.

From time-to-time, Netformx may engage third parties to track and analyze usage and volume statistical information from visitors and users. Netformx may also use other third-party cookies to track the performance of advertisements. The information provided to third parties does not include personal information, but this information may be re-associated with personal information after Netformx receives it.

B. Web Bugs

A web bug is used to compile information about users' and visitors’ usage of the Site and interaction with emails from Netformx. Web bugs are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular website tied to the web bug. The use of the web bugs improves the Site and email communications from Netformx.

Linked Websites

Netformx may provide links to other third-party websites and services, which are outside Netformx's control and not covered by this Privacy Statement. Netformx encourages you to review the privacy statements posted on those websites (and all websites) you visit.

Your Choices and Selecting Your Communication Preferences

Netformx gives you the choice of receiving a variety of information that complements the Site and the Products and Services. You can manage your communication preferences and unsubscribe using one of the following methods:

  • A. Each promotional email from Netformx includes instructions on how you can unsubscribe from that particular mailing.

Your California Privacy Rights - Applicable to Residents of the State of California only!

Residents of the State of California, under California Civil Code § 1798.83, have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed Personal Information during the preceding year for direct marketing purposes. Alternatively, the law provides that if the company has a privacy policy that gives either an opt-out or opt-in choice for use of your Personal Information by third parties (such as advertisers) for marketing purposes, the company may instead provide you with information on how to exercise your disclosure choice options.

Netformx qualifies for the alternative option. Netformx has a comprehensive Privacy Statement, and provides you with details on how you may opt-out or opt-in to the use of your Personal Information by third parties for direct marketing purposes. Therefore, Netformx is not required to maintain or disclose a list of the third parties that received your Personal Information for marketing purposes during the preceding year.
